1. Scope of application and acceptance of the GCS

These general terms and conditions of sale (hereinafter the "GTCS") define the terms and conditions of sale of the products marketed by Majolia (hereinafter the "Seller") on its website www.le-majolia.com (hereinafter the "Site").

Majolia is a one-person simplified joint stock company, registered with the Lyon Trade and Companies Register under number [93964528900017, intracommunity VAT FR61939645289. Its head office is located at 33 rue de la République, Allée B, 69002 Lyon, France.

Any order placed on the Site implies full and complete acceptance of these GCS by the Customer (hereinafter the "Customer"). These GCS prevail over any other document and may be updated by the Vendor, the applicable conditions being those in force at the time of the order.

2. Products

The products offered by Majolia are top-of-the-range dealcoholized wines, whose characteristics are detailed on the product sheets available on the Site. This information includes in particular:

- Composition and nutritional information

- Manufacturing method and origin

- Tasting and storage advice

Photographs and descriptions of Products are given for information only. Due to natural variations, the Seller cannot guarantee an exact match between the image displayed and the Product received.

Products are available while stocks last. In the event of unavailability after an order has been placed, the Vendor will inform the Customer as soon as possible and offer a refund or replacement.

3. Controls

3.1 Ordering process

The Customer selects the Products and adds them to his/her basket before proceeding to the following steps:

- Basket validation

- Enter personal and delivery information

- Choice of delivery method and applicable charges

- Payment method selection

- Acceptance of the GTC and final validation

A confirmation email is sent once the order has been validated.

3.2 Order refusal or cancellation

The Vendor reserves the right to refuse or cancel an order in the event of :

- Previous dispute with the Customer

- Suspected fraud or attempted irregular payment

- Unexpected unavailability of Products

The customer may cancel his order within 2 hours of validation, provided it has not yet been dispatched. The request must be sent to contact@le-majolia.com, indicating the order number. After dispatch, only the provisions relating to the right of withdrawal (article 6) apply.

4. Prices and payment terms

4.1 Pricing

Prices displayed on the Site are indicated in euros (€) including all taxes (TTC), excluding delivery costs. Delivery charges are added to the total amount before the order is validated.

The Vendor reserves the right to modify its prices at any time, but the applicable price is that in force at the time the order is placed.

4.2 Secure payment

Payment is due immediately upon ordering and can be made via :

- Credit card (Visa, Mastercard, American Express)

- PayPal

- Other payment methods indicated on the Site

In the event of refusal of payment by the bank, the order will be cancelled.

Products remain the property of the Vendor until full payment has been received. In the event of non-payment after dispatch, the Vendor reserves the right to demand the return of the Product at the Customer's expense.

5. Delivery

5.1 Zones and delivery times

The Vendor delivers to mainland France and certain European countries. Average delivery times are :

- 2 to 5 working days for mainland France

- 3 to 7 working days for the European Union

These times are given as an indication and may vary depending on the carrier and exceptional circumstances (strikes, health crises, etc.).

5.2 Costs and terms

Delivery charges are calculated automatically according to weight and destination. The customer is informed of this before the order is validated.

The customer can choose between home delivery via the Colissimo carrier and delivery to a relay point via the Mondial Relay carrier.

Delivery is free for orders of six (6) bottles or more.

5.3 Receipt of Products

Upon receipt, the customer must immediately check the condition of the package. In the event of a damaged or missing parcel, the customer must :

- Refuse the parcel and give a reason on the delivery note

- Report the incident within seventy-two (72) hours of delivery to the carrier and the Vendor by e-mail (contact@le-majolia.com) or by post with acknowledgement of receipt (Majolia, 33 rue de la République, Allée B, 69002 Lyon), with supporting evidence (photos). Once this period has elapsed and if these formalities have not been complied with, the Products will be deemed to be in conformity and no claim will be accepted by the Vendor.

The Customer must provide a complete and correct address for delivery. In the event of an incorrect or incomplete address, refusal of the parcel or insufficient information preventing delivery, the Vendor cannot be held responsible for any delays or quality of service. If a new presentation of the parcel is necessary, the related costs will be charged to the Customer.

6. Right of withdrawal

6.1 Exercising the right of withdrawal

In accordance with current regulations, the Customer has a period of fourteen (14) days from receipt of the Product to exercise his right of withdrawal from the Vendor. This request may be made without having to provide any justification and without incurring any additional costs, with the exception of the cost of returning the Product. Refunds or exchanges will only be granted if the Products are returned in their original condition, intact, unopened, unused, in perfect condition and in their original packaging. Any opened or damaged product will not be accepted for return or refund. The Customer must return the Product(s) no later than fourteen (14) days following the communication of his/her decision to withdraw.

6.2 Return procedure

Customers wishing to exercise their right of withdrawal must return the Product(s) concerned in their original packaging, intact, with all their accessories. The return request must be made by registered mail with acknowledgement of receipt (Majolia, 33 rue de la République, Allée B, 69002 Lyon).

6.3 Returns and associated costs

Products must be returned to the address indicated by the Vendor at the time of the retraction request. The Customer is required to keep a proof of shipment attesting to the sending of the parcel.

The Vendor will assume the return shipping costs, except in the case where the Customer returns a Product that does not comply with the stated conditions (e.g.: product used, damaged, incomplete).

In this case, the parcel will be returned to the Customer at his expense, and no refund will be granted.

6.4 Refunds

If the return conditions are met, the Vendor undertakes to reimburse in full the sums paid by the Customer, including the initial delivery costs, within a maximum period of fourteen (14) days following receipt of the returned Products.

The refund will be made by the same means of payment used at the time of purchase.

If the returned Product shows signs of use or damage affecting its resale, no refund will be made and the Product will be returned to the Customer at the Customer's expense.

7. Legal warranties

All products sold by the Vendor benefit from the legal guarantees in force: legal guarantee of conformity (articles L.217-4 et seq. of the French Consumer Code) and guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

7.1 Legal warranty of conformity

The customer has a period of two (2) years from receipt of the product in which to report a lack of conformity. He may choose between :

- Repair or replacement of the product, subject to the cost conditions stipulated by law.

- Refund or price reduction if repair or replacement proves impossible or too time-consuming.

During the 24 months following delivery, the Customer does not have to prove the existence of the defect.

7.2 Warranty against hidden defects

If a hidden defect renders the product unusable or significantly reduces its usefulness, the Customer may :

- Obtain a full refund by returning the product.

- Ask for a price reduction and keep the product.

The customer has two (2) years after discovery of the defect to make use of this warranty.

7.3 Implementation of warranties

Any complaint must be sent to the Seller by registered mail with acknowledgement of receipt to Majolia, 33 rue de la République, Allée B, 69002 Lyon.

The request must include proof of purchase and a description of the problem (photos if necessary). If a return is required, the Seller will provide the address and return instructions.

The applicable legal texts can be found in the French Consumer Code (articles L.217-4 to L.217-12) and the French Civil Code (articles 1641 to 1648).

8. Personal data protection

Pursuant to Law 78-17 of January 6, 1978, as amended by Law no. 2018-493 of June 20, 2018, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 ("RGPD"), we remind you that the personal data requested from the Customer is necessary for the processing of his/her order and the preparation of invoices.

The data collected is strictly used for order processing and commercial relations. Customers may exercise their rights (access, rectification, deletion) by contacting the Vendor by e-mail (contact@le-majolia.com).

9. Intellectual property

All content on the Site, including but not limited to text, images, logos, graphics, videos, and all other original works, remains the exclusive property of Majolia and is protected by applicable intellectual property laws.

Any reproduction, distribution, exploitation or use, in whole or in part, of any of the elements of the Site, in any form whatsoever and by any process whatsoever, without the prior written authorization of Majolia, is strictly prohibited and may be subject to legal action.

10. Applicable law and disputes

10.1 Applicable law

These GTC are governed by French law.

10.2 Mediation and recourse

In the event of a dispute relating to an order placed on the Site, the Customer is invited to contact Majolia's customer service department as a matter of priority in order to attempt to resolve the dispute amicably. Any complaint may be sent by e-mail (contact@le-majolia.com) or by post to the head office (Majolia 33 rue de la République, 69002 Lyon).

If no amicable agreement is reached, the consumer customer has the possibility of having free recourse to a consumer mediator, in accordance with the provisions of articles L.611-1 et seq. of the French Consumer Code.

The mediator, who is independent and impartial, will help the parties reach a mutually satisfactory solution.

If no amicable solution is found, the dispute may be brought before the competent courts within the jurisdiction of Majolia's registered office in accordance with the rules of common law in force.
